Terms & Conditions
NIOSHE Terms & Conditions govern the use of the NIOSHE website, digital portals, Academic Services, Student Services, Authorised Training Centre (ATC) services, Centre services and other applicable facilities made available through NIOSHE. By accessing or using the website or applicable services, you agree to follow these Terms & Conditions together with other policies published on the NIOSHE website.
Please read these terms carefully before using NIOSHE services. If you do not agree with applicable terms, you should not use the relevant service.
1. About These Terms & Conditions
These Terms & Conditions establish the general rules applicable to users interacting with NIOSHE through its website, portals and applicable academic or administrative services.
Additional instructions, eligibility requirements, notices or service-specific conditions may apply to particular Courses, Admissions, Examinations, Results, Certificates, ATC operations or other services.
Where a specific service has additional applicable requirements, users are expected to comply with those requirements along with these Terms & Conditions.
2. Who May Use NIOSHE Services
NIOSHE services may be used by Students, applicants, parents or guardians where applicable, Authorised Training Centres, Centres, authorised institutional representatives and other users permitted to access the relevant service.
Users must provide accurate information and must not falsely represent their identity, authority, Student status, institutional status or relationship with NIOSHE.
3. Acceptance of Terms
By accessing the NIOSHE website, creating or using an account, submitting information, applying for an applicable service or otherwise using NIOSHE digital services, you acknowledge that you have had an opportunity to review these Terms & Conditions.
Continued use of an applicable service constitutes acceptance of the terms and policies governing that service, subject to applicable law.
4. User Information
Users are responsible for providing information that is accurate, complete and current to the best of their knowledge.
Information provided during Admission, registration, account creation, academic processing or other services may be used for legitimate academic, administrative, verification and service-related purposes.
Providing deliberately false, misleading, altered or fraudulent information may result in rejection of an application, restriction of services, suspension of access or other appropriate action.
5. Student Registration and Accounts
Where Student registration or account access is provided, the Student is responsible for reviewing the information associated with the account and reporting material errors through an authorised process.
A Student account should be used only by the authorised Student or by another person who has legitimate authority to assist that Student where applicable.
Users must not attempt to access another Student’s account, records or protected information without proper authority.
6. Account Security
Users are responsible for maintaining the confidentiality of passwords, authentication information and other account credentials associated with NIOSHE services.
Users should:
- Keep login credentials confidential.
- Use only accounts they are authorised to access.
- Avoid sharing passwords or authentication details with unauthorised persons.
- Use reasonable precautions when accessing an account from a shared or public device.
- Report suspected unauthorised account access promptly.
NIOSHE may take reasonable security measures, including restricting or suspending access, where suspicious or unauthorised activity is identified.
7. Admission and Registration
Admission or registration may be subject to applicable eligibility criteria, documentation requirements, verification procedures, schedules and other academic or administrative conditions.
Submission of an application, documents, enquiry or other information does not by itself guarantee Admission, registration or approval.
An application may require review and verification before it is accepted.
8. Accuracy of Admission Information
Applicants are responsible for ensuring that information submitted during an Admission or registration process is accurate.
Where an application is submitted through an authorised ATC or Centre, the Student and the submitting institution should review the relevant information before final submission wherever the process permits.
Errors identified after submission may require a formal correction process and supporting documentation.
9. Documents and Verification
Users may be required to provide documents for applicable academic, administrative or verification purposes.
Documents submitted to NIOSHE must be genuine and must relate to the relevant applicant, Student, ATC, Centre or authorised person.
NIOSHE may request clarification, additional documentation or verification where reasonably necessary.
Submission of forged, manipulated, misleading or unauthorised documents may result in rejection, restriction of services or other appropriate action.
10. Academic and Skill Development Services
NIOSHE may provide or facilitate Academic Services, Skill Development opportunities and related educational services according to the information applicable to each Course or programme.
Users should review available Course information, eligibility requirements and applicable instructions before enrolling or participating.
Course structures, learning resources, schedules or applicable processes may be updated where reasonably necessary for academic or operational purposes.
11. Examination Services
Students participating in an Examination must comply with applicable Examination rules, schedules, eligibility requirements and instructions.
Students are responsible for reviewing relevant Examination information and ensuring that required formalities are completed within applicable timelines.
NIOSHE may take appropriate action where Examination rules are violated or where fraudulent, unfair or unauthorised practices are identified.
12. Admit Cards
Where Admit Cards are provided, availability may depend on successful completion of applicable registration, verification, eligibility and administrative requirements.
Students should carefully review information displayed on an Admit Card and report a material discrepancy through the appropriate channel where correction is required.
An Admit Card should not be altered, manipulated or used by an unauthorised person.
13. Examination Conduct
Students are expected to follow applicable Examination instructions and maintain appropriate conduct.
Prohibited Examination conduct may include impersonation, cheating, unauthorised assistance, manipulation of Examination records, use of prohibited material or other unfair practices.
Violations may result in action consistent with applicable academic rules and procedures.
14. Results
Results may be made available through applicable NIOSHE services after relevant academic and administrative processing.
Students are responsible for checking Result information through official channels.
If a discrepancy is identified, the Student should use the applicable review or correction process rather than altering or misrepresenting the Result.
15. Certificates and Academic Documents
Certificates and other academic documents may be issued or made available only where applicable requirements have been completed and the Student is eligible for the relevant document.
NIOSHE may verify records before issuing, correcting, replacing or confirming an academic document.
Certificates, Results, Admit Cards and other academic documents must not be forged, manipulated, fraudulently reproduced or used to misrepresent a person’s academic status.
16. Authorised Training Centres (ATCs)
Authorised Training Centres may receive access to specific institutional services according to their approved status and permissions.
ATCs must use their access only for legitimate and authorised NIOSHE-related activities.
An ATC is responsible for ensuring that its authorised users handle Student information and portal access appropriately.
17. ATC Responsibilities
ATCs and their authorised representatives are expected to:
- Provide accurate institutional information.
- Use portal access only for permitted activities.
- Submit Student information accurately and with appropriate authority.
- Protect Student information from unauthorised access.
- Keep institutional login credentials secure.
- Follow applicable Admission and academic procedures.
- Avoid making unauthorised guarantees or representations on behalf of NIOSHE.
- Maintain appropriate records relating to activities performed through their authorised access where required.
18. Centre Responsibilities
Centres and their authorised users must comply with the permissions and responsibilities applicable to their account and services.
A Centre must not use its access to obtain information or perform actions outside its authorised role.
NIOSHE may review Centre activity where reasonably necessary for security, administration, compliance or investigation of suspected misuse.
19. No Unauthorised Representation
No Student, ATC, Centre, employee, representative or other person may make commitments, guarantees or representations on behalf of NIOSHE unless appropriately authorised to do so.
Users should verify unusual claims through official NIOSHE channels before relying on them.
20. Fees and Payments
Where a service requires payment, applicable fees and payment instructions should be reviewed before completing the transaction.
Users are responsible for ensuring that payment information and transaction details are correct before confirming a payment.
A payment does not automatically establish eligibility for an academic service where separate Admission, verification, Examination or other requirements apply.
21. Payment Records
Users should retain applicable receipts, transaction references or payment confirmations for their records.
If a payment appears successful but the corresponding service is not updated, the user should contact NIOSHE or the appropriate authorised channel with the relevant transaction information.
Payment-related corrections may require verification against available transaction records.
22. Refunds and Cancellations
Any refund or cancellation request will be subject to the policy, eligibility conditions and circumstances applicable to the relevant service.
Users should not assume that every payment is automatically refundable. Certain fees may relate to services, processing, registration or other activities that have already been initiated or completed.
Where a separate refund or cancellation policy is provided for a service, that policy should be read together with these Terms & Conditions.
23. Website and Portal Use
Users may access the NIOSHE website and applicable portals only for lawful and authorised purposes.
Users must not intentionally interfere with website functionality, security mechanisms, databases, servers, accounts or other technical systems.
24. Prohibited Activities
Users must not:
- Attempt to gain unauthorised access to NIOSHE systems or accounts.
- Use another person’s credentials without proper authority.
- Submit fraudulent or deliberately misleading information.
- Manipulate Student, Examination, Result or Certificate records.
- Introduce malicious code or intentionally disrupt website functionality.
- Attempt to bypass security or access controls.
- Scrape or extract protected information through unauthorised automated methods.
- Impersonate NIOSHE, a Student, ATC, Centre or authorised representative.
- Use NIOSHE services for unlawful, fraudulent or abusive activities.
25. Suspension or Restriction of Access
NIOSHE may temporarily or permanently restrict access to an account or service where reasonably necessary because of suspected fraud, security risks, misuse, unauthorised access, violation of applicable terms or other legitimate operational concerns.
Where appropriate, further verification may be required before access is restored.
26. Intellectual Property
Unless otherwise stated, NIOSHE branding, website design, original text, graphics, documents, digital materials and other original content may be protected by applicable intellectual-property rights.
Access to the website does not grant users ownership of NIOSHE content or permission to use protected material in an unauthorised manner.
27. Permitted Use of Website Content
Users may view applicable website information for legitimate personal, educational or authorised institutional purposes.
Users must not reproduce, modify, republish, sell, commercially exploit or misleadingly present protected NIOSHE content without appropriate permission where permission is required.
28. NIOSHE Name and Branding
The NIOSHE name, logo or other branding must not be used in a manner that falsely suggests official authorisation, affiliation, partnership or endorsement.
Unauthorised websites, social-media accounts, advertisements, documents or other materials must not impersonate NIOSHE or mislead users regarding their relationship with NIOSHE.
29. Third-Party Links
The NIOSHE website may contain links to third-party websites or services for convenience or informational purposes.
NIOSHE does not control independent third-party websites and is not responsible for their content, availability, privacy practices or terms.
Users should review the applicable policies of an external service before providing information or completing a transaction on that service.
30. Third-Party Technology Services
NIOSHE may use third-party technology providers for hosting, infrastructure, communications, security, analytics or other operational requirements.
The availability of certain digital features may therefore depend partly on systems operated by independent providers.
Temporary interruptions affecting such services may occasionally affect NIOSHE website or portal functionality.
31. Service Availability
NIOSHE aims to maintain reasonable availability of its website and digital services but does not guarantee uninterrupted access at all times.
Access may be temporarily affected by maintenance, updates, security work, network problems, hosting issues, third-party interruptions or circumstances outside reasonable operational control.
32. Changes to Services
NIOSHE may update, modify, improve, replace, suspend or discontinue website features or services where reasonably necessary for academic, administrative, technical, security or operational reasons.
Where a change materially affects an applicable process, relevant information may be updated through appropriate NIOSHE channels.
33. Communications
Users may receive communications related to Admissions, accounts, Examinations, Results, Certificates, academic services, support, security or other applicable administrative matters using contact information provided to NIOSHE.
Users should keep relevant contact information accurate where an applicable service permits updates.
34. Privacy and Personal Information
Personal information submitted through NIOSHE services may be handled according to the NIOSHE Privacy Policy.
Users should review the Privacy Policy to understand how information may be collected, used, stored and protected through applicable NIOSHE services.
35. User Responsibility for Devices and Internet Access
Users are responsible for maintaining the devices, internet connectivity, browser or other technology necessary to access online NIOSHE services.
Users should take reasonable precautions to protect their devices against malware, unauthorised access and other security risks.
36. Accuracy of Website Information
NIOSHE aims to provide accurate and current information. However, typographical, technical or administrative errors may occasionally occur.
Where an error is identified, NIOSHE may correct or update the relevant information.
For important academic or administrative decisions, users should review the latest applicable information available through official NIOSHE channels.
37. No Guarantee of Individual Outcomes
Participation in a Course, programme, Skill Development service or other educational activity does not guarantee a particular Examination Result, employment opportunity, income, career outcome or other individual result.
Individual outcomes may depend on performance, participation, eligibility, preparation and other circumstances.
38. Disclaimer
Use of the NIOSHE website and services is also subject to the applicable NIOSHE Disclaimer.
The Disclaimer provides additional information concerning website content, Academic Information, external services, technical availability and limitations relating to the use of information.
39. Limitation of Liability
To the extent permitted by applicable law, NIOSHE will not be responsible for indirect, incidental or consequential loss arising solely from circumstances outside its reasonable control, including internet failures, unauthorised third-party actions, external service interruptions or misuse of an account by a user who failed to protect their credentials.
Nothing in these Terms & Conditions is intended to exclude or restrict any responsibility that cannot lawfully be excluded or restricted.
40. Indemnity for Misuse
To the extent permitted by applicable law, a user may be responsible for losses or claims resulting from that user’s unlawful use of NIOSHE services, deliberate misuse of systems, fraudulent submissions, infringement of rights or unauthorised representations made in the name of NIOSHE.
41. Fraud and Misrepresentation
NIOSHE may investigate suspected fraud, impersonation, forged documents, unauthorised alteration of records, misuse of accounts or other deceptive activities affecting its services.
Where reasonably necessary, relevant access may be restricted and appropriate action may be taken in accordance with applicable procedures and law.
42. Force Majeure and Events Beyond Reasonable Control
NIOSHE may not be able to perform certain services normally where performance is prevented or materially affected by events outside reasonable operational control, including natural disasters, government restrictions, major network failures, infrastructure disruptions, cyber incidents or other exceptional circumstances.
Where reasonably possible, affected services may be restored or alternative arrangements communicated after circumstances permit.
43. Changes to These Terms & Conditions
These NIOSHE Terms & Conditions may be updated from time to time to reflect changes in services, academic processes, technology, security practices, operational requirements or applicable law.
The latest version will be published on this page. Users are encouraged to review these Terms & Conditions periodically.
44. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable under applicable law, the remaining provisions should continue to apply to the extent permitted by law.
45. No Waiver
A failure or delay by NIOSHE to exercise a right or respond to a particular violation does not automatically constitute a permanent waiver of that right or of future enforcement where appropriate.
46. Contact NIOSHE
If you have questions about these Terms & Conditions, an applicable service or an issue involving your Student, ATC or Centre access, please use the official Contact NIOSHE page.
When contacting NIOSHE, provide enough information to identify the relevant issue while avoiding unnecessary disclosure of passwords or confidential login credentials.
47. Entire Understanding
These Terms & Conditions should be read together with the NIOSHE Privacy Policy, Disclaimer and any additional terms, notices or requirements specifically applicable to a service.
Together, these materials establish the applicable conditions for using the relevant NIOSHE website and digital services.
48. Acceptance of NIOSHE Terms & Conditions
By continuing to access or use the NIOSHE website or applicable services, you acknowledge that you have had an opportunity to read and understand these NIOSHE Terms & Conditions and agree to comply with the requirements applicable to your use of the services.
